Summary

Mandatory wage transparency for job postings and employee pay information. This bill would require employers to list the wage or wage range in any public or internal job posting, give wage range information to applicants before discussing compensation and on request, provide employees their position's wage range at hire and at least annually and on request, and ban retaliation for exercising these rights.

Penalties and lawsuits for pay transparency

If enacted, employers who break these rules could face a $5,000 penalty for a first violation. Each later violation would add $1,000, up to a $10,000 maximum penalty. Each affected worker or applicant could recover $1,000 to $10,000, or actual damages if higher, plus attorneys' fees and court orders to fix the problem. You could sue in Federal or State court, alone or with others in similar situations. Employers would be barred from retaliating, like refusing to interview, hire, or promote you for using these rights.

Workers would see pay ranges upfront

This bill would require employers to list the pay or pay range in any public or internal job posting. If no posting is shared with you, they would have to tell you the pay before talking about pay, and anytime you ask. If you are hired, they would tell you your pay range at hire, at least once a year, and on request. "Wage range" would mean what the employer expects in good faith to pay. It could be based on a pay scale, prior ranges, pay of similar roles, or the job's budget.
