$2-per-pound credit for formula makers

This bill would create a $2-per-pound credit for infant formula made and sold for use in the United States. It would count up to 18 million pounds per year, for up to $36 million. Businesses would qualify if prior-year global revenue was $750 million or less, or if they received this credit last year. The credit would run only for five taxable years starting when a business first claims it. Formula made at facilities that used the 30% investment credit would not count; credits could be sold or taken as elective payment.

30% credit to build formula factories

This bill would create a 30% tax credit for equipment used to make infant formula in the United States. Only businesses with $750 million or less in prior-year global revenue could qualify. Credits would be allocated: up to $150 million per project and $750 million total. Applicants would need to certify at least 50% of first-year output is sold for use in the U.S., and place the project in service within 3 years. Credits could be sold or taken as elective payment, and a one-year clawback could apply; projects starting construction more than 10 years after enactment would not qualify.
