HR2111119th CongressWALLET

To amend the Federal Food, Drug, and Cosmetic Act to exempt the premium cigar industry from certain regulations.

Sponsored By: Representative Donalds

Introduced

Summary

Would exempt premium cigars from federal tobacco-product regulation. It would add a narrow statutory definition of "premium cigar" to the Federal Food, Drug, and Cosmetic Act so qualifying cigars are not treated as "tobacco products" under federal law.

Show full summary
  • About 1% of U.S. adults use premium cigars. Youth use is low. Only 0.6% of premium cigar users are under 18.
  • The change would shield many family-owned premium cigar makers and age-controlled specialty retailers from federal tobacco-product rules.
  • The bill sets eight criteria for a "premium cigar," including a whole-leaf wrapper, handmade construction, no flavors other than tobacco, only tobacco water and vegetable gum as ingredients, and a minimum weight of 6 pounds per 1,000 cigars.

Fewer federal rules for premium cigars

This bill would treat certain premium cigars as not a "tobacco product" under federal law. To qualify, a cigar would have to meet eight rules, including a whole-leaf wrapper, a 100% leaf binder, handmade rolling with simple tools, no filter or non-tobacco tip, and no flavors other than tobacco. It could only contain tobacco, water, and vegetable gum, must have at least 50% long-filler by weight, and weigh over 6 pounds per 1,000 cigars. If exempt, makers, importers, and retailers of these cigars could face fewer federal tobacco-product compliance steps and lower costs. The bill does not set an effective date or a sunset.
