  • Families and students: It would require an Individualized Health Care Plan (IHCP) and an Individualized Emergency Health Care Plan (IEHP) developed with the student’s health care provider, parent, and school nurse. Plans are to include physician orders, symptoms and care steps, accommodations for activities, and communication protocols.
  • School staff and drivers: Local educational agencies must ensure staff are trained at least every 2 years on seizure care using Department of Education–approved courses from nonprofit national epilepsy organizations. School bus drivers transporting affected students must receive notice of the condition, emergency contact information, and seizure recognition and first aid training.
  • States and local districts: The Secretary would award competitive grants to States, which would subgrant to local educational agencies to fund training, student education, medication administration training, and hiring compliance staff. Grant funds must supplement, not replace, other Federal or State funds.
  • Legal protections: School employees acting in good faith would be shielded from liability except for willful misconduct, gross negligence, or recklessness.

School seizure training and care plans

If a district gets a subgrant, a school nurse would coordinate seizure care. Staff, including after-school staff, would be trained at least every two years using an Education Department–approved course from national epilepsy groups. Bus drivers who transport a student with epilepsy would get notice, basic training, and emergency contacts. Parents could allow sharing medical info so individualized health and emergency plans can be created and signed by the provider, parent, and nurse. Plans would follow provider guidance and are recommended to include care steps, sports and trip needs, and communication rules. Subgrant money may also train staff to give seizure medicine, teach students, and hire compliance staff. School employees acting in good faith under these rules would have liability protection, excluding willful misconduct, gross negligence, or recklessness.

Grants for seizure-ready schools

This bill would set up a competitive grant program for States. States would apply and then pass funds to school districts to support students with epilepsy. Congress would be authorized to spend $34.5 million for fiscal years 2026 through 2030. The new funds would have to supplement, not replace, other federal or state money for these activities.
