Restore Protections for Dialysis Patients Act
Sponsored By: Representative Kelly (PA)
Introduced
Summary
Restore protections for dialysis patients. This bill would bar group health plans from singling out dialysis for worse benefits or from shifting primary payment responsibility for dialysis care to Medicare.
Show full summary
- People with end-stage renal disease (ESRD) would be protected from plan rules that differentiate dialysis benefits compared with other covered medical services.
- Group health plans would be prohibited from using an ESRD diagnosis or need for dialysis to apply benefit limits that disparately affect those patients. Plans could still choose which renal dialysis providers to include in their networks.
- The bill would amend 42 U.S.C. 1395y(b)(1)(C) to clarify the prohibition and direct the Secretary of Health and Human Services to enforce it consistent with nonconformance determination rules in 42 CFR part 411.

Protect dialysis patients in group plans
If enacted, group health plans could not treat people who need dialysis worse than other enrollees. Plans would be barred from limiting benefits or setting networks in ways that hit ESRD patients harder. Plans would not have to include a specific dialysis clinic or a set number of clinics. The Health Secretary would enforce these rules under Medicare’s existing processes, and they would take effect upon enactment.
