Allow surplus broiler hatching eggs to be sold to egg breakers for processing into liquid egg products. The bill would make a specific FDA shell-egg rule inapplicable to those surplus broiler hatching eggs and require the Food and Drug Administration, working with the Department of Agriculture, to issue a revised rule within 180 days to permit holding conditions that are compatible with hatching and sale for processing.

- Broiler hatcheries and farmers would be able to sell surplus broiler hatching eggs to egg breakers instead of being constrained by the current shell-egg rule. Those eggs could be held at temperatures and for periods that match hatching conditions so they can be processed.
- Egg breakers and food manufacturers would gain access to additional supply of eggs to process into bulk liquid egg products. An “egg breaker” is a commercial facility that breaks eggs and sells the liquid product in bulk to food manufacturers.
- The Food and Drug Administration, acting through the Commissioner of Food and Drugs and consulting the Department of Agriculture, would have 180 days to revise section 118.4 of title 21, Code of Federal Regulations to implement these changes.

Hatcheries could sell surplus hatching eggs to processors
If enacted, surplus broiler hatching eggs could be sold to egg breakers for liquid processing. Starting on the date of enactment, a current FDA rule would not apply to these surplus eggs when they are headed to an egg breaker. Within 180 days, FDA, in consultation with USDA, would need to issue a new rule. The new rule would allow these eggs to be kept at hatching-like temperatures and still be sold to egg breakers. This could boost the supply of liquid eggs and may lower costs for food makers and shoppers.
