This bill would change who counts as a tipped employee. It would remove the old $30-per-month test. Instead, an employee would be treated as tipped for an employer-chosen work period if tips plus other cash wages for that period, when combined with the required cash wage under current tip-credit rules, are at least equal to the federal minimum wage. Employers could pick work periods like 1 day, 1 week, every 2 weeks, every 28 days, or each pay period.
