  • Plan sponsors and law alignment: The bill would add parallel language to the Internal Revenue Code and the Employee Retirement Income Security Act and make conforming edits so including these employees does not disqualify a governmental plan. Protect pensions for contracted responders

If enacted, government pension plans could include certain contracted first responders without losing “governmental plan” status. This would apply only if you work for a tax‑exempt public safety agency and meet the federal definition of an emergency response provider. Substantially all your work must be firefighting or out‑of‑hospital EMS for a city or county under a contract with your agency. The bill would align ERISA and tax code rules so these workers are treated the same for related pension limits. It would apply for plan years beginning after the date of enactment.
