Summary
Allow certain contract first responders to join governmental pension plans without stripping the plans' tax-favored status. This bill would target firefighters, emergency medical technicians, and paramedics who work for tax-exempt public safety agencies that contract with local governments.

- Firefighters and emergency medical providers: Eligible first responders employed by qualifying 501(c) public safety agencies would be able to participate in state or local governmental pension plans and access those retirement benefits.
- Public safety agencies: Tax-exempt public safety organizations that operate under contract with a political subdivision could enroll their emergency response employees without causing the hosting pension plan to lose its governmental classification under the tax code.
- Plan sponsors and law alignment: The bill would add parallel language to the Internal Revenue Code and the Employee Retirement Income Security Act and make conforming edits so including these employees does not disqualify a governmental plan. The changes would apply for plan years beginning after enactment.

Protect pensions for contracted responders
If enacted, government pension plans could include certain contracted first responders without losing “governmental plan” status. This would apply only if you work for a tax‑exempt public safety agency and meet the federal definition of an emergency response provider. Substantially all your work must be firefighting or out‑of‑hospital EMS for a city or county under a contract with your agency. The bill would align ERISA and tax code rules so these workers are treated the same for related pension limits. It would apply for plan years beginning after the date of enactment.
