- Livestock producers and employees would be allowed to capture, kill, disperse, or transport black vultures (Coragyps atratus) that are causing or are reasonably believed likely to cause death, injury, or destruction to livestock. This authority operates notwithstanding the Migratory Bird Treaty Act.
- Anyone who takes a black vulture would have to submit an annual report by January 31 for the prior 12 months, once the reporting form is available. The Director of the U.S. Fish and Wildlife Service would have 180 days after enactment to create and post a reporting form.
- The bill expressly prohibits taking black vultures using poison and permits injury to a vulture in the course of taking it.

Farmers could take threatening black vultures
If enacted, livestock producers and their on-the-job employees could take a black vulture that is killing livestock or likely to harm it. "Take" would include capturing, killing, dispersing, or moving the bird's carcass. You could act on a reasonable belief of risk. You could not use poison. This would apply even though migratory birds are usually protected by federal law.
Annual report for farmers who take vultures
If enacted, anyone who takes a black vulture under this authority would need to file a yearly report. The report would be due by January 31 for the prior 12 months. You would send it to your U.S. Fish and Wildlife Service regional office, using the official form. You would not need to report until the Director posts the form, which must be online within 180 days after enactment. The form could not be more burdensome than similar migratory bird permit forms.
