Show full summary
  • Cape Fox Village Corporation: The bill waives the core township selection requirement for about 185 acres of unconveyed township land and lets Cape Fox submit a written selection within 90 days to receive roughly 180 acres of Federal surface land, with conveyances to be completed within 180 days. This transfer would satisfy Cape Fox's entitlement under the Alaska Native Claims Settlement Act.
  • Sealaska Corporation: Sealaska would receive the subsurface estate for the conveyed land and the transfer would count toward its Section 14(f) subsurface entitlement.
  • Public and third parties: The conveyance would be subject to a public access easement to reach National Forest land on Revillagigedo Island and would remain subject to valid existing rights, reservations, and rights-of-way unless the parties agree otherwise.

Cape Fox land transfer with public access

If enacted, this would let Cape Fox Village Corporation choose about 180 acres in the Tongass National Forest. The land is shown on a map dated December 18, 2023. Cape Fox would have 90 days after enactment to send a written notice. The Interior Department would then transfer the surface to Cape Fox and, at the same time, give the subsurface to Sealaska Corporation. The transfers would be finished within 180 days of the notice and would count toward their entitlements under the Alaska Native Claims Settlement Act. A public access easement from George Inlet to inland National Forest land would remain on the property. The transfers would also stay subject to existing rights and rights-of-way unless the parties agree otherwise. The bill would also waive a prior rule that Cape Fox must select about 185 acres in the Saxman township (about 40 acres and about 144.57 acres, as listed in the bill).
