Funding set aside for Program

If enacted, the bill would require the Secretary to use at least 5 percent of OSHA's annual appropriations each fiscal year to carry out this Act. That means a recurring share of OSHA's budget would be directed to run and support the new Program.

New voluntary workplace safety program

If enacted, the bill would create the Michael Enzi Voluntary Protection Program to recognize employers who adopt comprehensive safety systems. Approved worksites would be exempt from programmed OSHA inspections while they participate. Employers would need to apply, perform annual self-evaluations, and allow onsite evaluations that would not result in OSHA enforcement citations. Any serious hazard found in an evaluation would have to be corrected within 90 days (or sooner if 90 days is not feasible). OSHA would supervise worksite audits directly, and employers already in the prior voluntary program in good standing would be able to continue under the new Program.

Program rollout and free employer tools

If enacted, the bill would require the Secretary to issue final Program regulations and begin implementation not later than two years after enactment. The Secretary would also have two years to write a technology modernization plan to update applications, annual self-evaluations, audit reporting, and other Program tools. The bill would create a Basic, no-cost Tiered Challenge inside OSHA to let employers evaluate safety systems, and OSHA could not charge employers to participate.
