  • Federal rules and agencies: The Secretary must specify that the reissued rule supersedes any contrary rule in effect on the date of issuance. The bill also defines "Federal conscience and anti-discrimination laws" to match the meaning given in the former rule.

Restore 2019 conscience protections in health care

Within 6 months after enactment, the Secretary of Health and Human Services would have to issue a final rule. It would be identical or very close to the 2019 conscience rule at 45 CFR part 88, as of July 22, 2019 (84 Fed. Reg. 23170). The new rule would say it overrides any conflicting rule in place when it is issued. The bill would also use the same definition of “Federal conscience and anti-discrimination laws” as that 2019 rule. This could strengthen refusal protections for health care workers and entities, while some patients could face delays or extra steps to get certain services.
