Mandatory detention for theft-related cases

If enacted, some noncitizens tied to burglary, theft, larceny, or shoplifting would face mandatory detention. This would apply when they are otherwise inadmissible and are charged, arrested, convicted, or admit those acts. DHS would have to issue a detainer and quickly take custody if no one else holds them. The crimes would mean what local law says where they happened.

States could sue over immigration releases

If enacted, state attorneys general could sue to enforce detention and removal rules and get quick court review. They could challenge releases, bond or parole decisions, and some visa actions when harm is over $100. Courts would have to move these cases fast, and some limits on injunctions would not apply. Parole decisions would be tied to DHS, and states could challenge alleged violations of the case-by-case parole rule.
