Streamlining Critical Mineral Permitting Act
Sponsored By: Representative Carter (GA)
Introduced
Summary
Would expand interim hazardous waste permit eligibility to facilities that process or refine "critical energy resources". The bill would let the Secretary of Energy designate which energy resources are "critical" by finding they are essential to U.S. energy systems and have supply chains vulnerable to disruption, and it would allow facilities that process or refine those designated resources to seek interim permits under Subtitle C with final approval by the Administrator of the Environmental Protection Agency.

Interim permits for critical energy facilities
If enacted, some processing or refining facilities for energy resources could qualify for an interim hazardous waste permit. This would apply only if the Energy Secretary labels the resource as “critical.” It adds a new eligibility path in the existing permit rules, but EPA would still need to approve the interim permit. The change would start upon enactment and only apply to facilities that meet the new definitions.
