Improving SCRA Benefit Utilization Act
Sponsored By: Representative McClain Delaney
In Committee
Summary
This bill strengthens servicemembers' consumer financial protections under the Servicemembers Civil Relief Act (SCRA), focusing on interest-rate limits and making it easier for members to use them. It adds those protections to military training, requires additional notice timing for reserve members, and changes creditor procedures so debts and related obligations are treated consistently when a member is called to service.
Show full summary
- Service members and their dependents gain clearer access to SCRA interest-rate caps. Creditors must treat pre-service debts and related obligations under the cap as of the date the member is called to service, and servicemembers can submit necessary documents online, by mail, or by fax to qualify obligations.
- Reserve component members must receive SCRA notice when they first enter reserve service and again if mobilized or ordered to active duty for more than 30 days.
- Military training and preparedness under 10 U.S.C. 992 must include consumer financial protections and knowledge about interest-rate limits so members can identify and use these rights.

Stronger SCRA protections for servicemembers
If enacted, creditors would have to limit interest on a servicemember's pre-service debts to 6% from the date the member is called to service. The 6% limit would also apply to other debts you owe the same creditor, even if you did not list them. Creditors would have to accept documents online, by mail, or by fax, and you would choose the method. The Department of Defense would add SCRA consumer protections and the 6% rule to required financial training. You would get a notice about SCRA protections when you first enter military service. Reservists would get a notice when they first join the reserves. They would get another notice if called to active duty for more than 30 days.
