HR3300119th Congress

Forest Protection and Wildland Firefighter Safety Act of 2025

Sponsored By: Representative LaMalfa

In Committee

Summary

This bill would block the need for an NPDES permit when aircraft spray Forest Service–approved products for fire control. It would add a new item to 33 U.S.C. 1342(l)(3) saying discharges from aerial application of products on the Forest Service Qualified Products List, or any successor list, are exempt from NPDES permit requirements and would update and reorganize cross-references in that subsection to reflect current terminology.

No water permits for aerial fire drops

If enacted, aerial firefighters and contractors would not need water pollution permits for discharges from aerial drops of approved fire‑control products. The product would need to be used for fire control or suppression and be on the Forest Service Qualified Products List (or a successor list). If a product is not on the list, the permit rules would still apply. The text provided does not include an effective date.
