Improving Access to Small Business Information Act

Sponsored By: Representative Rep. Kim, Young [R-CA-40]

Passed House

Summary

Exempts the SEC's Advocate for Small Business Capital Formation from several Paperwork Reduction Act information-collection steps to reduce procedural burden. It amends Section 4(j) of the Securities Exchange Act of 1934 so the Advocate's actions do not count as a "collection of information" under subchapter I of chapter 35 of title 44. The change removes the need to submit those collections to the Office of Management and Budget, to display a PRA control number, or to state that a collection is PRA-cleared. Specific PRA provisions listed in the statute remain applicable.

Less SEC paperwork for small businesses

If enacted, small businesses would face less paperwork when the SEC’s Small Business Advocate asks for information. Those requests would not count as a Paperwork Reduction Act “collection.” The SEC would not need to send them to OMB, show a PRA control number, or certify PRA clearance. Some PRA rules would still apply. This only applies to requests by the Advocate under Exchange Act subsection 4(j).
