Summary

Protects health care entities from federal penalties for refusing to participate in abortion care or coverage. The Conscience Protection Act of 2025 would prohibit the federal government and any recipient of federal financial assistance from penalizing, retaliating against, or discriminating against health care entities that do not perform, refer for, pay for, or cover abortions. It would also preserve voluntary participation and allow accrediting bodies and governments to set competency standards for providers who knowingly and voluntarily elect to perform abortions.

  • Federal and state recipients of funds: Would face investigations handled by the Department of Health and Human Services and the Office for Civil Rights, and the Secretary could require corrective action or terminate federal financial assistance to induce compliance.
  • Individuals and other entities harmed by a violation: Would be able to bring civil suits without first exhausting administrative remedies. The Attorney General or any adversely affected party could sue recipients of federal funds, including states, and courts could award injunctions, compensatory damages, and attorneys’ fees.
