Would create a federal safe harbor shielding non-controlling blockchain developers and providers from money-transmitter and other licensing or registration rules. It would say a developer or provider is not a money transmitter or a financial institution, and is not subject to other licensing or registration requirements, unless the developer or provider has unilateral control over digital assets that a user is entitled to.

Safe harbor for blockchain developers

If enacted, blockchain developers and service providers without "control" over users' digital assets would not be treated as money transmitters or financial institutions. They would generally not have to get money-transmitter licenses or register under those laws. The safe harbor would not apply if, in regular business, they can unilaterally move a user's digital assets. States could enforce matching state laws, but conflicting state or local rules would be blocked. The bill would define key terms and would not change intellectual property law.
