This bill would create new federal civil protections for victims of non-consensual intimate images and AI-made "intimate digital forgeries," updating federal law to define deepfakes, set who can sue, and specify remedies and limits for those harms. It preserves existing federal, State, and Tribal laws and lets States or Tribes adopt rules that are at least as protective.

New protections from AI intimate forgeries

If enacted, this would expand the federal civil action on nonconsensual intimate images to cover AI-made intimate forgeries. It would define who counts as an identifiable person by face, unique marks, or info shown with the image. It would define an intimate digital forgery as a fake intimate image made with software or AI that looks real to a reasonable person. The rule would apply even if the image is labeled as fake. It would also make clear that sexually explicit conduct involving an identifiable person is covered.
