HR4582119th CongressWALLET

To amend the Family and Medical Leave Act of 1993 and title 5, United States Code, to clarify that organ donation surgery qualifies as a serious health condition.

Sponsored By: Representative Bacon

Introduced

Summary

This bill would make recovery from surgery related to organ donation explicitly count as a _serious health condition_ under the Family and Medical Leave Act. It adds the same language for federal civil service rules and lets federal employees substitute other available leave for parts of the 12-week FMLA period when serving as organ donors.

Show full summary
  • Families and donors: Would give a clearer legal basis for eligible organ donors to seek FMLA leave for recovery after donation.
  • Private-sector employees: Would amend the FMLA definition by inserting “(including recovery from surgery related to organ donation)” after “physical or mental condition,” widening the law's qualifying conditions.
  • Federal civil service employees: Would add the same phrase to title 5 and allow employees who use any part of the 12-week FMLA period to serve as an organ donor to substitute, as much as possible, leave available under section 6327.

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

Family leave after organ donation

If enacted, eligible workers could use family and medical leave to recover from organ donation surgery. This would not change who qualifies for FMLA or the 12-week limit. It would simply make clear that organ donation recovery counts as a serious health condition.

Federal workers: organ donor leave changes

If enacted, federal civil service employees could take family leave to recover from organ donation surgery. You would also need to use any leave you have under section 6327 for as much of that time as possible. This would not change the 12-week total. It clarifies coverage and how your leave is charged.
