Limits on taking minors for out-of-state abortions

This bill would make it a federal crime to take a minor across a state line for an abortion. It would apply when the trip cuts off a parent's rights under the minor's home-state parental-involvement law. That means the abortion happens outside the home state without the consent, notice, or court OK that state requires. A person could be fined or jailed up to one year. It would not apply if the abortion is needed to save the minor's life. The minor and any parent would not face charges for the travel. A defendant could argue they reasonably thought a parent had consented or been notified, or show a court waiver. A harmed parent could sue, unless that parent committed incest. This would take effect 45 days after enactment.

Doctor notice before out-of-state minor abortions

This bill would require doctors to notify a parent at least 24 hours before an abortion for a minor who lives in another state. If actual notice fails after reasonable effort, the doctor would send certified mail, return receipt requested, restricted delivery. Delivery would be deemed 48 hours after noon on the next mail-delivery day after mailing, excluding no-delivery days. A doctor who knowingly breaks this rule could be fined or jailed up to one year. Exceptions include following the performing state's parental-involvement law, a court waiver from the home state, a signed abuse claim with required child-abuse reporting, a life-saving emergency with written notice to a parent within 24 hours after, or when the minor is with someone who proves they are the parent. A harmed parent could sue, unless that parent committed incest. This would take effect 45 days after enactment.
