This bill would impose a nationwide ban on a set of food color additives. It would deem those additives unsafe and make foods that contain them adulterated under the Federal Food, Drug, and Cosmetic Act starting January 1, 2027.

  • Consumers: Shoppers and families would see products reformulated or removed from shelves. Foods containing the listed colors would be unlawful after Jan. 1, 2027.
  • Food makers and suppliers: Manufacturers would have to stop using the specified additives or reformulate recipes. The bill names 11 additives, including Red No. 40 and titanium dioxide, and also covers any substantially similar substances.
  • Regulators: The Food and Drug Administration could enforce the change by treating foods with these additives as adulterated under existing adulteration provisions of the FD&C Act.

Food dyes banned starting 2027

If enacted, starting January 1, 2027, certain food dyes would be banned in foods. The ban would cover Red No. 40, Red No. 3, Yellow Nos. 5 and 6, Blue Nos. 1 and 2, Green No. 3, Orange B, Citrus Red 2, and titanium dioxide, plus similar additives. Foods that contain them would be deemed unsafe and adulterated under federal law, regardless of current FDA approvals. FDA could act to stop their sale; makers, importers, and stores would need to reformulate or pull products. You may see ingredient changes or fewer dyed foods on shelves.
