Summary

Creates a federally recognized, REAL ID–compliant photo release card for U.S. citizens leaving federal prison. It would give people a short-term government photo ID to help them prove identity and access services after release.

  • People leaving federal custody: The Bureau of Prisons would be required to issue a photo release card that meets REAL ID minimum standards. The card must be issued within 180 days and be valid for at least 18 months.
  • States and state prisoners: The Bureau of Prisons Director would negotiate with each state so the release card can be used to obtain a state-issued ID. The Attorney General would also issue guidance to states on photo release cards for people leaving state correctional facilities and the Director must report to Congress annually with the first report due within one year.
  • Federal benefits and buildings: Federal programs and activities would have to accept the release card as proof of identity for items like Social Security, Medicare, Medicaid, SNAP, TANF, Department of Education and Housing programs, the Department of Veterans Affairs, and entry into Federal buildings.

Photo ID for people leaving federal prison

If enacted, the Bureau of Prisons would give U.S. citizens leaving federal prison a photo ID that meets REAL ID standards. The Director would start within 180 days of enactment. Each card would last at least 18 months from the release date. Federal agencies would accept the card for Social Security, Medicare, Medicaid, SNAP, TANF, HUD, VA, Education, probation and supervision, and entry to Federal buildings. This would apply only to people released from BOP facilities who are U.S. citizens.

Release ID would not replace prerelease planning

If enacted, the release ID would not replace the Bureau of Prisons’ prerelease planning duties. The Bureau would still have to provide prerelease planning under existing law. This is a clarification, not a new benefit.

States get guidance on release ID cards

If enacted, the Attorney General would give States guidance within one year on issuing release ID cards for people leaving state prisons. The BOP Director would negotiate with each State so the BOP release card can be used to get a state ID. The Director would report to House and Senate Judiciary Committees within one year and then every year. “State” would include the 50 States, D.C., and U.S. territories.
