FAIR Act of 2025
Sponsored By: Representative Johnson (GA)
Introduced
Summary
Ends mandatory predispute arbitration for employment, consumer, antitrust, and civil rights disputes. The bill would invalidate predispute arbitration agreements and predispute joint-action waivers in those four areas, letting individuals and small businesses pursue claims in court instead of being forced into private arbitration.

No forced arbitration for workers and consumers
This bill would bar companies from forcing you into arbitration before a dispute exists. It would cover work, consumer, civil-rights, and many antitrust class cases. You would be covered whether you are called an employee or an independent contractor. Predispute class or collective action waivers would also be invalid. You could still choose arbitration after a dispute starts. The ban would apply only to disputes that arise on or after the enactment date.
Courts decide if arbitration applies
If enacted, a court—not an arbitrator—would decide if this law applies and if an arbitration clause is valid. You could still choose arbitration after a dispute starts. Union contracts could keep arbitration for labor issues, but they could not waive your right to go to court to enforce constitutional or statutory rights.
