Non-Domiciled CDL Integrity Act

Sponsored By: Representative Rouzer

In Committee

Summary

This bill would tighten rules for issuing commercial driver’s licenses to non-domiciled individuals, making domicile and immigration checks central. It would limit state issuance to people domiciled in the issuing state or to narrowly defined exceptions for those domiciled in other U.S. jurisdictions or foreign jurisdictions under a federal rulemaking.

Show full summary
  • States would need to confirm an applicant’s lawful immigration status or U.S. citizenship or lawful permanent resident status before issuing, transferring, renewing, or upgrading a CDL under the new rules.
  • Applicants domiciled in foreign jurisdictions would be eligible only if they have lawful immigration status, hold a visa the Secretary ties to an employment-based reason for a CDL, and receive a license for up to 1 year or until their authorized U.S. stay ends.
  • Applicants domiciled in Puerto Rico, the U.S. Virgin Islands, Guam, American Samoa, or the Northern Mariana Islands would be eligible only with proof of U.S. citizenship or lawful permanent resident status confirmed by the state.
  • The Secretary of Transportation would prescribe implementing regulations and require states to retain issuance records for at least 2 years and provide those records to the Secretary within 48 hours when requested.

Stricter commercial driver license rules

This bill would limit states to issuing a commercial driver license only to residents, unless regulations set by the Secretary allow an exception. Applicants would need to operate or plan to operate a commercial vehicle. If you live abroad, you would need lawful U.S. status and a work visa tied to the CDL job. Any such license would last up to 1 year or until your authorized stay ends, whichever is shorter. If you live in Puerto Rico, Guam, the U.S. Virgin Islands, American Samoa, or CNMI, you would need to show U.S. citizenship or lawful permanent resident status. States would have to confirm status before issuing, renewing, transferring, or upgrading, keep records at least 2 years, and provide them to the Secretary within 48 hours if asked.
