Easier owner-financing rules for sellers
If enacted, the bill would exempt small sellers who finance home sales from some federal mortgage licensing rules. You would qualify if you make 24 or fewer owner-financed loans in a 12-month period and are not a bank. Each loan must be secured by property you own and be fully amortizing. For the Truth in Lending rules, rates must be fixed or not change for at least five years. Sellers must also document a good-faith determination of the buyer's ability to pay. The exclusion also covers many manufactured-home loans, with similar limits, and would take effect on enactment.
