One-time Lockerbie victim payments
If enacted, the Treasury would create a Living Victims of Lockerbie Claims Trust Fund within 30 days. The bill would appropriate $42,066,338 to that Fund, available until spent. Payments would be made only after the Foreign Claims Settlement Commission certifies approved claims. Each approved claimant (or a deceased claimant's personal representative) would receive an equal share: $42,066,338 divided by the number of certified claims.
Fast filing and award process
If enacted, the Foreign Claims Settlement Commission would publish a claims notice in the Federal Register within 30 days. The notice would set a filing deadline no later than 60 days after publication. The Commission would have 60 days after the filing period ends to decide which filers qualify and to certify approved claims to the Treasury for payment.
Who qualifies as a compensable victim
If enacted, the bill would define a compensable living victim with five rules. To qualify you must be a U.S. person; have been age 45 or older on Dec 3, 1991; have been employed by Pan American World Airways on Dec 3, 1991; have been a named claimant in Abbott et al. v. Socialist People's Libyan Arab Jamahiriya (1:94-cv-02444-SS); and have been alive on Aug 14, 2008.
