Stop Penalizing Working Seniors Act
Sponsored By: Representative Latta
Introduced
Summary
Allows people whose only Medicare coverage is hospital insurance under Part A to continue contributing to Health Savings Accounts (HSAs). The bill would add an exception to the Internal Revenue Code so the rule that normally stops HSA contributions does not apply to individuals whose only Medicare entitlement is Part A under section 226(a), and it would apply for taxable years beginning after December 31, 2024.

Allow HSA contributions for Part A seniors
This bill would let seniors who have only Medicare Part A keep adding money to a Health Savings Account (HSA). You would still need to meet HSA rules, like being in an HSA-eligible high-deductible plan and not having other disqualifying coverage. This would apply only while your Medicare is Part A-only. It would take effect for tax years starting after December 31, 2024. If passed, this could help eligible seniors save pre-tax money for medical costs.
