If enacted, this bill would ask USMCA partners to adopt foreign investment reviews like Section 721 of the Defense Production Act. It would add clear definitions, including "critical infrastructure" and a list of strategic sectors such as artificial intelligence, semiconductors, biotechnologies, and space. The U.S. Trade Representative would push for a coordination group run with the Secretaries of State and the Treasury to share threat information and notify partners about risky investments. USTR and the Treasury would also provide technical help to Canada and Mexico and consult relevant Congressional committees during the first joint USMCA review after enactment.
