Leftover BEAD funds for broadband
If enacted, BEAD-eligible entities would have to use any leftover grant money to run a new competitive subgrant program. Subgrants could pay for fiber, conduit, carrier-neutral internet exchange points, mobile wireless, submarine landing stations, workforce training, NG9-1-1 work, mapping, and related projects. Subgrantees would normally need to pay at least 25% of project costs, but waivers and in-kind match are allowed. Ongoing operations and maintenance could be paid for only up to 24 months and only up to 15% of a subgrant. The program would bar subgrants that mainly build data centers and would require public posting (at least 14 days) and a 30-day deadline to resolve wholesale fiber challenges.
Buy America waiver kept for BEAD
If enacted, the bill would let the Assistant Secretary make rules about Buy America waivers for BEAD recipients. It would also prevent changing or rescinding the Assistant Secretary's February 22, 2024 waiver notice for BEAD recipients. That would keep the current domestic-content waiver in place for these broadband grants.
Next Generation 9-1-1 planning rules
If enacted, the Assistant Secretary would coordinate with State NG9-1-1 contacts and give technical help and oversight for NG9-1-1 projects. Eligible entities using leftover funds for NG9-1-1 would need to certify they coordinated with each local emergency communications center and name one implementation contact. Those entities would have to submit a plan covering interoperability, system reliability, multimedia handling, cybersecurity (including intrusion detection), governance, stakeholder input (including Tribal and rural), and procurement that uses open competitive processes. The Assistant Secretary would review and approve proposed uses of remaining amounts for NG9-1-1 and oversee NG9-1-1 subgrants.
Fast BEAD guidance and labor help
If enacted, the Assistant Secretary would have to issue guidance to implement these changes within 30 days. Guidance on workforce programs must be developed with the Secretary of Labor. The guidance should follow the federal Uniform Guidance rules (2 C.F.R. part 200) as much as practicable.
