Summary

Creates a new wage exclusion for eligible K–12 public school educators. The bill would let qualifying public school teachers, aides, counselors, and instructors exclude a large portion of their wages from gross income for taxable years beginning after December 31, 2025.

  • Public school educators: An individual who works at least 900 hours in a school year as a K–12 teacher, instructor, counselor, or aide could exclude up to $50,000 of wages from taxable income.
  • High-need educators and schools: Educators at schools where at least 75 percent of students qualify for free or reduced-price meals, educators in rural schools, and those who teach special education or STEM would be eligible for a larger exclusion of up to $65,000.
  • Schools and implementation: Schools must be able to provide statements showing an educator meets the hours and eligibility tests and the Secretary must prescribe rules and a process for certification.

Tax break for public K-12 teachers

If enacted, the bill would let eligible public K-12 educators exclude up to $50,000 of wages from federal gross income each taxable year. The exclusion would rise to $65,000 if, for the taxable year, the school has at least 75% of students eligible for free or reduced-price lunches, the school is in a rural area, or the educator teaches special education or STEM. An eligible educator would be a K-12 teacher, instructor, counselor, or aide who worked at least 900 hours in a school year that ends during the taxable year at a public elementary or secondary school. The Treasury Secretary would issue rules and require schools to provide statements verifying hours and the higher-limit tests. The change would apply to taxable years beginning after December 31, 2025.
