Ban sale of VA patient data

If enacted, this bill would bar the VA Secretary from signing any contract that lets a contractor sell or disclose veterans' sensitive personal data for money. It would define which VA contracts are covered and what counts as covered information, including protected health information and personally identifiable information (including anonymized data) and material protected under 5 U.S.C. 552a; 38 U.S.C. 5701 and 7332; and 45 C.F.R. parts 160, 161, and 164. The VA would have to ensure every covered contract includes a clause forbidding monetization, sale, or misuse of covered information by contractors, subcontractors, affiliates, or other non-Department entities, or issue a directive giving guidance to staff and contractors. Not later than one year after enactment, the Secretary would have to send the Committees on Veterans' Affairs a report with the required contract clause, the guidance, and a summary of other steps taken to comply.
