Abortion Is Not Health Care Act of 2025
Sponsored By: Representative Rep. Biggs, Andy [R-AZ-5]
Introduced
Summary
Removes abortion payments from the itemized medical expense deduction. This bill would amend the Internal Revenue Code to disallow amounts paid for an abortion when calculating the medical and dental expense deduction under Section 213. Under current law, taxpayers who itemize may include legal abortion costs when medical expenses exceed 7.5% of adjusted gross income. The amendment would apply to taxable years beginning after enactment and would prevent taxpayers who itemize from deducting abortion expenses.

No tax deduction for abortions
If enacted, you could not count money you paid for an abortion as a medical expense when claiming the medical expense deduction. This change would apply to taxable years beginning after the date of enactment. If you paid for an abortion and claim that deduction, you could lose that portion of the deduction and may pay more tax.
