Summary
This bill would ensure Federally Qualified Health Centers (FQHCs) pay no more than the 340B ceiling price at the point of purchase for covered outpatient drugs. It would also clarify that later rebates or reconciliations cannot be used to justify paying more upfront.

Lower drug costs at community health centers
If enacted, this bill would stop community health centers covered by 340B from being forced to pay more than the 340B ceiling price when they buy outpatient drugs. It would bar the HHS Secretary from making agreements with drug makers that require payment above the applicable ceiling price at the time of purchase. The bill would also prevent arrangements where a center pays more up front and later gets rebates, reimbursements, or other payments to make up the difference. The changes would take effect on the date of enactment and apply to drugs bought on or after that date.
