- Each state's initial apportionment would be its share of total 2012 apportionments multiplied by the total funds available. Those amounts are then adjusted so a state's combined apportionments cannot fall below a floor equal to 95% of its share of recent Highway Trust Fund tax payments.
- The change applies to combined apportionments for programs under sections 119, 133, 148, 149, 167, 175, and 176(c), and to funds for carrying out section 134.
- Apportionments would be made each October 1 for fiscal year 2026 and for every fiscal year thereafter according to the new formula.

New way to split highway money
This bill would change how the federal government splits several combined highway funds among states. Starting in fiscal year 2026, the Secretary would apportion these funds each October 1. First, each state would get its share based on that state's 2012 apportionment share times the total money available. Then each state's amount would be raised if needed. The floor is 95% of the state's recent share of Highway Trust Fund tax payments. The Mass Transit Account would be excluded from those tax payment calculations. This would move money between states and affect state road projects and maintenance.
