No Federal Tax Dollars for Illegal Aliens Health Insurance Act of 2026

Restrict federal health insurance funds to U.S. citizens and lawfully present immigrants. This bill would change the Affordable Care Act's section 1332 waiver rules so pass-through federal payments cannot be used to offset premiums, cost-sharing, or any other benefit for people who are not citizens, nationals, or lawfully present.

Ban federal marketplace help for noncitizens

If enacted, the bill would stop states from using federal 1332 pass-through funds to pay premiums, cost-sharing reductions, or other benefits for people who are not U.S. citizens, nationals, or lawfully present. It would also remove the requirement in section 1312(f)(3) from HHS’s rules for approving state 1332 waivers, which could change which waiver designs are allowed. The bill would require HHS to rescind, within 30 days after enactment, any existing 1332 waivers approved before enactment that would not have been approved under these new rules.
