Private labs could upload DNA

If enacted, this bill would let the Attorney General permit eligible private forensic DNA labs to directly upload qualifying DNA profiles to the National DNA Index System (NDIS). To be eligible, a lab would need at least five consecutive years of ISO/IEC 17025 accreditation and external audits every two years showing compliance with FBI Quality Assurance Standards. Labs would also have to be privately owned, follow the NDIS Memorandum of Understanding and Operational Procedures Manual, and meet federal limited-access and privacy rules for DNA samples and records. Private labs would only be allowed to submit qualifying profiles; they would not be allowed to search, query, or retrieve NDIS data beyond submission. The Department of Justice and FBI would have to issue rules on eligibility, direct-upload procedures, and security and privacy safeguards not later than six months after enactment, and the Attorney General, in consultation with the FBI Director, would update NDIS policies and manuals as needed.
