  • Families: Parents at Title I schools would receive daily direct payments equal to the per-student, per-day share of Title I funds for each closure day. They must spend the money on listed "qualified educational expenses" or return unused amounts within 30 days after in-person instruction resumes.
  • Local education agencies: LEAs would be required to set up a Failure to Open Direct Payment Plan by the first school year after enactment and to carry it out when a covered school misses more than three days. LEAs must track payments with receipts or require returns to ensure funds pay for education-related items.
  • Students who need extra services: Payments may be used for tutoring, private classes, curriculum and instructional materials, testing fees, diagnostic tools, and educational therapies for students with disabilities so learning and services can continue during closures.

Payments to parents when schools close

This bill would require local school districts to set a Failure to Open Direct Payment Plan. Districts would have to do this by the first school year after enactment. If a covered public school is closed for more than 3 days in a school year because of a public health emergency or a collective bargaining action, parents would be paid directly. The daily payment per student would be the school's funds under this part divided by the number of students and by the number of school days. Payments would equal that per-day amount times the number of closed days. Payments would be made to parents each day the school fails to open, when practicable. Parents would have to spend the money on listed educational expenses, keep receipts, or return unused amounts within 30 days after the school reopens.
