HR8230119th CongressWALLET

NO TOD Act

Sponsored By: Representative Perry

Introduced

Summary

Removes transit-oriented development projects from eligibility for two major federal transportation loan and credit programs. It also ends a federal Transit-Oriented Development planning pilot program to narrow program support for TODs.

Show full summary
  • Transit agencies and developers would no longer be able to use TIFIA or RRIF for projects defined as transit‑oriented development, including project components designed for commercial or residential use. This cuts a financing route commonly used for large mixed‑use projects.
  • Local governments and planners would lose access to the dedicated Transit‑Oriented Development Planning Pilot, reducing a federal source of planning support and technical assistance for TOD efforts.
  • Federal program rules and authorities would be tightened rather than expanded. The bill does not create new funding and the changes apply to applications submitted on or after enactment.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 0 benefits, 2 costs, 0 mixed.

End federal TOD planning pilot

If enacted, the bill would remove the federal Transit-Oriented Development (TOD) Planning Pilot by striking subsection (b) of section 20005 of MAP-21. The pilot would end upon enactment. Metropolitan planning organizations and local governments would no longer have that federal planning support. The change would not provide new funding.

Bar loans for transit-oriented projects

If enacted, the bill would make transit-oriented development projects ineligible for TIFIA and RRIF assistance. It would define a transit-oriented project as any project or project components designed for commercial or residential use. The restriction would apply to applications submitted on or after the date of enactment. Developers, local governments, and project sponsors would have fewer federal loan options.
