Monthly and yearly HOPE limits
If enacted, the bill would set HOPE contribution limits by month and year. The baseline yearly limit is $4,000 for self-only coverage and $8,000 for certain family head-of-household cases. You must have required coverage on the first day of the month to be eligible for that month. Employer and approved State contributions together may not exceed half your limit. These dollar amounts would be indexed for inflation after 2026.
Taxes and penalties for wrong withdrawals
If enacted, HOPE distributions used only for qualified medical expenses would be excluded from income. Distributions not used only for qualified medical costs would be taxable and generally subject to an extra 30 percent tax, with exceptions for death and certain disability distributions. The bill also limits rollovers (one per year, within 60 days) and adds excise-tax rules and return-of-excess rules to HOPE Accounts.
Limits on employer and third-party help
If enacted, employer contributions to your HOPE Account could count as employer-provided medical coverage up to the legal limits. That favorable treatment would not apply if your prior-year AGI exceeds $100,000 (or $200,000 for joint filers). Employers would have to show HOPE contributions on Form W-2 and follow cafeteria plan rules.
New HOPE medical savings accounts
If enacted, the bill would create HOPE Accounts, a new tax-favored trust you could use to pay qualified medical costs. These trusts must be U.S.-organized and follow strict rules about trustees, cash-only contributions (except certain rollovers), and no life-insurance investments. Trustees would have to follow substantiation rules and file annual reports like Form 5498-A. The accounts would still pay tax on unrelated business income and face prohibited-transaction and trustee-reporting penalties.
