Military Spouse Hiring Act

Sponsored By: Senator Sen. Kaine, Tim [D-VA]

Introduced

Summary

Expands the Work Opportunity Tax Credit to spouses of active-duty service members. This change would let employers claim the hiring tax credit when they hire a certified military spouse, creating a new "qualified military spouse" category in the tax code.

Show full summary
  • Military spouses and families: Military spouses would become a recognized group for hiring incentives, which could improve job opportunities and earnings for spouses who move with service members.
  • Employers: Businesses that hire certified military spouses could claim the Work Opportunity Tax Credit for wages paid to those hires, starting with hires after enactment.
  • Tax code and administration: The bill would amend Internal Revenue Code section 51(d) to add the definition of "qualified military spouse" and make the rule apply to amounts paid or incurred after enactment for hires after that date.

Tax credit for hiring military spouses

You (as an employer) would be able to claim the Work Opportunity Tax Credit when you hire a certified military spouse. The worker must be certified by the designated local agency as the spouse of a U.S. service member on the hiring date. The hire must begin work after the date of enactment, and wages must be paid or incurred after that date. The bill does not set the credit amount or change other WOTC rules.
