Provides a backup funding source so the FAA can keep running at prior-year levels. This bill would let the Federal Aviation Administration continue the programs, projects, and activities that it funded in the preceding fiscal year using the Airport and Airway Trust Fund if Congress has not enacted FAA appropriations or a continuing resolution.

Keep air travel running during shutdowns

If enacted, the FAA could keep key programs running during a funding lapse. It would use Airport and Airway Trust Fund balances that are not already appropriated. Covered work includes FAA operations, facilities and equipment, research and development, airport grants, and costs for direct loans and loan guarantees. Spending could not exceed last year’s operating rate (or last year’s continuing resolution rate) and must follow last year’s terms. The authority would start on day one of a lapse and end when a regular appropriation or a continuing resolution becomes law. If still in effect at year end, the same levels would carry into the next fiscal year, and costs would be charged to the later appropriation once enacted. It would not apply if another law already continues or forbids funding. The bill would also add this authority to the tax code list that guides Trust Fund spending.
