Buffalo Tract Protection Act

Sponsored By: Senator Sen. Heinrich, Martin [D-NM]

In Committee

Summary

Withdraws about 4,288 acres near Placitas, New Mexico from mineral development to keep the federal government in control of subsurface minerals. The bill would withdraw land shown as Tracts A, B, C, and D on the Placitas, New Mexico area map dated November 13, 2019 from location, entry, and patent under the mining laws and from disposition under the mineral leasing, mineral materials, and geothermal leasing laws, subject to valid existing rights. It would still allow the Interior Secretary to convey the surface under the Federal Land Policy and Management Act or the Recreation and Public Purposes Act, but any conveyance must reserve the mineral estate to the United States.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

Block new mining on Placitas land

If enacted, the bill would withdraw about 4,288 acres of federal land in Placitas, New Mexico from new mining claims and new mineral leases. This would stop new location, entry, and patent under mining laws and bar mineral leasing, mineral materials disposals, and geothermal leasing on that land. The withdrawal would take effect on enactment and would not disturb valid existing rights.

Sell surface land but keep minerals

If enacted, the bill would let the Interior Secretary convey the surface estate of the described Placitas land under FLPMA or the Recreation and Public Purposes Act. Any sale or transfer of the surface would have to reserve the underground mineral estate to the United States. This change would apply only to the land shown on the Placitas map and would take effect on enactment.
