New voluntary PAID program for workers
If enacted, the bill would create a voluntary PAID program at the Labor Department to help fix unpaid minimum wage and overtime. The agency would review employer applications and supervise settlements. Affected employees would get a written settlement offer and could accept or decline. If you accept and the employer pays the full amount, you would waive your private FLSA claim for the violations covered. The bill would add anti-retaliation protection for accepting or declining a PAID offer.
New employer rules to use PAID
If enacted, employers could use PAID to voluntarily resolve wage mistakes. To apply, employers would submit a detailed self-audit, payroll records, wage calculations, and employee contact info. The agency would approve qualifying applications within 30 days and would not charge fees to apply. The Labor Department would publish compliance guides within 30 days after enactment. Information in applications would generally be protected from court discovery and not used in investigations unless serious safety or certain visa-related risks exist.
