Summary

Guarantees older workers the right to take age-discrimination claims to court rather than forced arbitration. The bill would add a new chapter to Title 9 that makes any predispute arbitration agreement or predispute joint-action waiver unenforceable for disputes about age discrimination against people aged 40 or older. It says courts, not arbitrators, must decide whether the chapter applies and whether an arbitration agreement is valid. The rule would cover claims under Federal, Tribal, or State law and apply to disputes that arise or accrue on or after enactment.

Choice to sue for age discrimination

If enacted, people age 40 or older who allege age discrimination would be able to choose court instead of arbitration. Predispute arbitration agreements and joint-action waivers would be invalid and unenforceable for those age-discrimination cases. A court, not an arbitrator, would decide whether the rule applies and whether an arbitration agreement is valid. This would cover federal, tribal, and state (including local) law. It would apply to disputes that arise or accrue on or after the date of enactment.
