Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

Stop forced arbitration for workers and consumers

If enacted, this would bar pre-dispute arbitration and class-waiver clauses in employment, consumer, antitrust, and civil-rights disputes. Courts, not arbitrators, would decide whether an arbitration agreement applies. It would apply only to disputes that arise or accrue on or after enactment. If passed, individuals and small businesses could join class or collective cases in court.

Union arbitration kept, court rights preserved

If enacted, arbitration in collective bargaining agreements between employers and labor organizations would remain valid. But those clauses could not stop a worker from asking a court to enforce constitutional, statutory, or public-policy rights. This would apply to disputes arising on or after enactment.
