The bill would create a statutory formula that makes the Secretary of Transportation compare year‑over‑year percentage changes and, when needed, reduce 405 funding and transfer the same amount to 402 to reach a 4-to-1 growth ratio.

Shift in highway safety funding shares

This bill would define the Transportation Secretary and the two funding streams, section 402 and section 405. Before any distribution, the Secretary would check whether 402 or 405 funding rose this year versus last year. If both rose, the Secretary would apply a 4-to-1 percent-increase test. If 402's percent increase is less than four times 405's, some 405 dollars would be cut and moved to 402 so the 402 increase equals four times the 405 increase. If 405 rises while 402 falls, the Secretary would transfer either all or part of the 405 increase as described. After any transfer, the adjusted 402 and 405 amounts would be distributed the same fiscal year. These rules would begin October 1, 2026.
