FDA must publish egg-labeling guidance
If enacted, the bill would require the Food and Drug Administration to issue draft guidance within 180 days and final guidance within one year on how the new egg-labeling rule will be enforced. The guidance would explain enforcement steps and help regulated companies and agencies understand how to follow the new rule.
New rules for businesses selling egg substitutes
If enacted, the bill would bar foods sold across state lines from using egg market names when they are marketed as egg substitutes but do not meet the bill's definition of an egg or egg product. The bill would define "egg" narrowly (the reproductive output of avian poultry with a calcium shell) and limit "egg product" to items listed in 21 CFR part 160. The bill would also say any prior FDA guidance that conflicts with this new rule would have no force on enactment. Makers, packagers, labelers, distributors, and retailers of egg-alternative products would likely need to relabel products or stop using egg words.
