RECAPTURE Act

Sponsored By: Senator Sen. Ernst, Joni [R-IA]

Introduced

Summary

Redirects undesignated remaining BEAD broadband funds into the Treasury for deficit reduction. The RECAPTURE Act would amend the Infrastructure Investment and Jobs Act to make sure any BEAD funds left over that are not tied to a specific purpose go to the federal general fund while funds specifically designated in final BEAD proposals still go to eligible entities.

Show full summary
  • Eligible entities: Would still receive any remaining BEAD money that is explicitly designated for a specific purpose in their final proposals so planned projects keep their assigned funds.
  • Federal budget and taxpayers: Any remaining BEAD funds not designated in final proposals would be deposited into the Treasury general fund for the sole purpose of reducing the federal deficit.
  • BEAD program administration: Clarifies reallocation language and tweaks approval cross-references to specify reallocations occur for application failures and to update internal clause references.

*Would direct undesignated BEAD funds into the Treasury to be used for deficit reduction.*

Leftover broadband funds sent to Treasury

If enacted, the bill would change how leftover BEAD broadband grant money is handled. Money that is already designated in a final BEAD proposal would still go to the eligible entity. Any remaining BEAD funds not designated for a specific purpose in the final proposal would be deposited in the U.S. Treasury to reduce the federal deficit. The bill would also clarify that funds can be reallocated to other eligible entities when applicants fail and would make small wording fixes in the BEAD rules. These changes would take effect upon enactment and could leave communities with less extra money for new broadband projects.
